January 15th, 2012
Often people have questions or issues concerning the commercial bail bonds industry in Indiana.  They would like to know about becoming a bail or recovery agent or what agents and companies are licensed to write commercial bail in Indiana.  Regrettably, on occasion there are consumer complaints.

The commercial surety bail bond industry in Indiana is regulated by the Indiana Department of Insurance (IDOI).   The IDOI’s Bail Bond Division oversees the licensing and continuing education  of bail bond and recovery agents, surety company compliance, consumer complaints among its many functions.

The IDOI may be reached through its Bail Bond Division website .

XR Bond

November 16th, 2011
A XR bond is a type of split bond created by the Marion County Indiana Superior Court system.  The XR bond is a hybrid combining two distinct bail bond types:  surety and percent.

The surety component of the XR bond is posted by a bail bondsman.  The bondsman charges 10% of the amount of the surety bond set by  the court.

The percent bond component of the XR bond may be posted by anyone  in tandem with the surety bond portion.  The percent bond is 10% the entire amount as set by the court.

Both components of the XR bond must be posted together at the same time and location.

Even if the defendant attends all court appearances, The Marion County Superior courts  may retain all or a part of the cash bond for costs and/or fees related to the case.   Any remaining part of the cash percent bond deposit  is then refunded.   The premium paid to the bail bondsman may not be refunded by law.

Payment for a Bail Bond

November 10th, 2011
Jeff Downer Bail Bonds IndianapolisQuestions concerning payment (called premium) for a bail bondsman’s services are often are posed to us at Jeff Downer Bail Bonds.  To start, it is important to understand that payment of surety bail bond premiums is strictly regulated in the State of Indiana.  The bail bond premium is sometimes confused with collateral, which is used to secure the bond, and is returned once the defendant makes all required court appearances.

The most common questions concern the amount paid to a bail agent for his services.  In Indiana that amount is set by law to be 10%, no more, no less.  In fact it is a crime, a felony, for a bail bondsman to charge anything other than 10% of the bond.   This 10% premium cannot be refunded once the bond is in effect.

How the bail bond premium may be paid is also regulated by the state.  Payment can only be made by: cash, check, credit card or debit card.  Property may not be used to pay the premium, but may be used as collateral.

Credit Debit Card Bail Bond PaymentsJeff Downer Bail Bonds can accept premium payments by all legal methods, including credit and debit cards anywhere with our mobile capabilities.  We understand payment issues, especially with XR and XC bond types can be confusing, and urge you to contact us with any questions about paying for bail bonds.
